What Is Gazumping and How Can You Avoid It When Buying Property?
If you’ve ever been in the middle of buying a property only to find out someone else swooped in with a better offer, you’ve experienced the sting of gazumping. It’s a frustrating and often emotional part of the property buying process—but understanding what it is and how to protect yourself can make all the difference.
What Is Gazumping?
Gazumping happens when a seller accepts a verbal offer from a buyer, but before contracts are exchanged, they accept a higher offer from someone else. This leaves the original buyer out in the cold, often after they’ve already spent money on legal fees, building inspections, and other pre-purchase costs.
Why Does Gazumping Happen?
In competitive property markets Gazumping is more common. Sellers are naturally drawn to higher offers, especially when demand is high and supply is tight.
How to Protect Yourself from Being Gazumped
While gazumping isn’t illegal and happens regularly there are steps you can take to reduce your risk:
- Pay the deposit immediately: Everyone loves to talk a big game in real estate, if you want the owner to take you seriously. Pay the deposit, this also allows you to sign a contract when you are ready to exchange.
- Get pre-approved finance: This shows sellers you’re serious and ready to move quickly and you are able to confidentially commit.
- Act fast: Once your offer is accepted, move swiftly to pay the deposit and exchange contracts once contracts are exchanged you are protected.
- Have a solicitor or conveyancers details ready: Choose one who understands the local market and can help expedite the process. You will need their contact information for the contract of sale.
- Consider a cooling-off waiver: In some cases, waiving your cooling-off period (with legal advice) can help secure the deal faster and knock out your competition.
- Build a relationship with your agent: A trusted real estate agent can keep you informed and help you stay ahead of other buyers as questions about their process and the owner’s instructions.
